Purchasing a license to use the media on this site from us, you acknowledge that no transfer of copyright exists, and you are purchasing a license to use the media as per the terms set out in this agreement.

Images(Photos, illustrations, etc)

1. Standard License:

Our standard license agreement is the Royalty-Free license which means you pay for the image only once and then you can use the image as many times as you like, with just a few restrictions. This is a one-person license and can be used only by the account owner or his employee, for the company’s own projects or clients and cannot be transmitted to another party. Royalty Free licensed images can be used on websites, TV-programmes, for educational projects, in magazines, newspapers, books or booklets, covers for books, flyers, games and any advertising and promotional materials, in either printed or electronic media.

You pay for the image only once and then you can use it as many times as you like there are no license fees except the initial fee and no other royalties to be paid except those included in the initial cost, the maximum number of copies for printed materials is 500,000 copies.

Any use is permitted except to include the images in products intended for sale.

You can use the image in a project. If you want to use it in a new project, buy a new license.

2. Extended:

They are licenses that extend the rights given with the regular Royalty Free license. Unless otherwise specified the restrictions imposed by the RF license still apply.

Web Usage – electronic Items for Resale: this license includes the right to use the photos for web templates that are sold to more customers, screensavers, e-cards, PowerPoint presentations or as wallpapers on cell phones. Maximum number of electronic items is 10,000 copies (applies as a total of each type of usage). If this amount is exceeded you need to acquire this license once again. The new license will provide you with the standard amount of copies.

Print Usage – Physical Items for Resale: includes the right to use the photos for t-shirts, postcards, greeting cards, mugs, mouse pads, posters, calendars, framed artwork that is to be sold to other customers for a maximum amount of 10,000 copies (applies as a total of each type of usage). If this amount is exceeded you need to acquire this license once again. The new license will provide you with the standard amount of copies.

3 Editorial license

Acceptable uses for the content of editorial use
You can use editorial content only for any article or story that is not designed for commercial use. There are no exceptions to this restriction, even religious and nonprofit organizations must comply with editorial guidelines. Some of the common ways to use content for editorial use include the following:

Standard license includes:
Web use: videos can only be used on social networking websites, in mobile applications and on sites such as YouTube or Vimeo. They can also be used in content that is downloaded digitally. The limit size of the audience for this type of web use is 500,000.
Live presentations: the videos can also be used in live presentations such as musicals, corporate presentations, recitals and musicals with an audience limit size of 500,000.
On websites: videos that are embedded in web pages have no restrictions on the size of the audience.

Extended license:
Television distribution: the extended license for Vicen photography videos allows the use of clips in television or commercial programs. It can also be used for distribution in any transmission, cable or satellite, distribution in movies or videos of free transmission or transmission services of the amazon or netflix prime style.

The Licensee/End User agrees that:

Image may not be used as trademark, service mark or logo unless copyright release is purchased

Copyright remains with me even if the licenced image is incorporated into other images or media.

Images will not be sub-licensed, assigned, transferred, given away, made available via on-line or other database.

The exception to this is if you have licensed the image for a client (e.g. website, advertising) when you must keep detailed records and make them available to the Copyright holder if requested. This is only likely to be required should an IP query arise. You may use the licensed image for one client. Should you wish to use the same image for another client you must licence it again.

Once you have completed payment for the license you are granted a non-exclusive, non-transferable right to use the image. “Non-transferable” means that the work you produce using a licensed Image must be for your own use, or if purchased on behalf of your employer or client, your employer or client must be the end-user of your work. You may not sell, rent, loan, give, sublicense, or otherwise transfer to anyone the Image, or the right to use an Image, and nothing you produce shall grant or purport to grant to any third party a right to use or duplicate an Image. You agree to take all commercially reasonable steps to prevent third parties from duplicating or distributing the Image.

No Unlawful use. Client will not use the Photos in any unlawful manner, such as pornography or defamation.

Other clauses

Photo Notice and Markings. Client does not need to include a photo credit or copyright notice on the Photos unless specifically requested by the Photographer.

Indemnification: Client will indemnify, defend, and hold harmless Photographer from all liability, claims, demands, causes of action, judgments, damages, and expenses (including reasonable attorneys ¨and experts¨fee and costs) arising out of or as a result from use the Photos by Client, except in the event that any claims, demands, causes of action, judgments, or expenses arose out of willful misconduct, gross negligence, or bad faith by Photographer.

Limitations of Liability. Except for any remedies that cannot be excluded or limited by law, neither party, nor any affiliate, will be liable under this agreement to the other party, any affiliate or other third person for any indirect, incidental, consequential, special, reliance, or punitive damages or lost or imputed profits, lost data or cost of procurement of substitute goods or services. This limitation of liability may not be valid in some states. Client may have rights that cannot be waived under consumer protection and other laws. Photographer does not seek to limit client´s warranty or remedies to any extent not permitted by law
Termination. Either party may terminate this agreement immediately upon delivery of written notice to the other party sepecifying clearly the grounds for termination if the other party commits a material breach of its obligations under this agreement and fails to cure the breach within thirty (30) days after written notice of the breach is received by the breaching party. For the avoidance of doubt, termination will be without prejudice to any liability incurred prior to the effective date of termination.

Assignment. This agreement may not be assigned by client without Photographer´s prior written consent. Photographer may assign this Agreement, in whole or in part, to any affiliate or successor.

Severability. If any provision of this agreement is held invalid, illegal or unenforceable by a court of competent jurisdiction, the remainder or the agreement will be valid and enforceable and the parties will negotiate in good faith a substitute, valid and enforceable provision which mos nearly puts into effects theintent of the parties.

No waiver. This agreement may not be altered, modified, or maended in any way except in writing signed by both parties. The failure of a party to enforce any provision of the agreement will not be construed to be a weiver of the right of such party to thereafter enforce that provision or any other provision or right.

Entire Agreement. This agreement represents and constitutes the entire agreement between the parties, and supersede and merge all prior negotiations, agreements, and understandings, oral or written, with respect to any and all matters between the parties.

Governing law. The parties hereby agree that this agreement will be governed by, and constructed and enforced in accordance with the laws of the Spain, without referencie to rules governing choice of laws.

Disputes. Any dispute arising from this agreement shall be resolved through mediation.

Attorneys´ Fees. If either party brings legal action to enforce its rights under this agreement, the prevailing party will be entitled to recover from the other party its expenses (including reasonable attorneys´ fees and cost) incurred in connection width the action an any appeal.

All notices, demands or other communicacions to be given under this agreement by either party to the other may be effected either by personal delivery in writing or by CORREO, registred or certified, postage prepaid with return receipt requested. Notices delivered personally will be deemed communicated as of actual receipt. Mailed notices will be deemed communicated as of two (2) days after mailing.

When you make a purchase, a receipt will be sent to you with the images and the type of license you have purchased. This together with the proof of payment serves as proof of the license purchased.

It is your responsibility to make good use of the images and videos, if you do not comply with the rules of the license acquired, you will lose your rights.

If the downloaded image has a major error, such as a shaky photo, the money will be returned unless you are benefiting from a promotion, such as volume discount codes.

Changes in the contract.

This contract can not be modified, if we change our licenses, it will be in a completely new contract with other names for the new licenses.

Sending a file

When you make the purchase you will be sent a link to Dropbox for the download (you do not need to have an account).
The link can take several minutes to several hours to arrive.
If after 24 hours the mail does not arrive, please get in touch.
The link is valid for 24 hours. After that time I will not be able to download the file.
And do not worry, your image will come to you.
